TERMS OF SERVICE

Upon commissioning and buying my adopts, I am going to now start getting confirmation of agreement to ToS. If you AGREE to these terms of service, art will be done or your design will be sold to you.

Failure to abide by the terms of service can mean revoking the design or commission. Some compensation can be repaid, if revoked. I will not always revoke, as I don't believe in revoking, it will most likely be you being blacklisted, asking for the character back and paying for it back (if art is added to it)

General Terms

Art may be used wherever, but it may not be used for profit without my EXPLICIT permission or for additional commercial charges.

Artwork  may be used wherever the commissioner pleases, whether that be on chat sites, art sites, forums, etc. The commissioner may NOT try to sell my art for profit or personal gain without my permission (verbal or written) OR unless they've bought commercial rights to monetize.

Art MAY give value to a character ONLY if it is a commission or a YCH; art the new owner cannot use, freebies, gift art or anything along those lines will bring NO  monetary value to characters. Abusing this will end you up on my  blacklist.

Premade art, similar to bases, must be bought by the new owner to be used. This means that premades made by me cannot just be simply given to the user without my explicit permission. This is to stop people from just giving away premades for free to their friends with designs I may have made. We can talk a smaller fee if you are using a lot of my premades, however, do not give others my art otherwise. It is not yours to give.

Schedule.
I work during the week, as I still have to do my other job to survive, and draw when I get home but mostly on the weekends. Please respect my privacy though if I choose during the  week one day to not do art. Saturday (or maybe also Fridays) will now be my  stream day, if I choose to stream!


Tracing vs. Referencing.
Light referencing my art for anatomy is flattering, however, tracing my art, redlining it when not asked or whatever, ESPECIALLY to post on your social media or for a product you  intend to keep or sell, is PROHIBITED.

References.
I have done art without references before, but I do PREFER them. IF you  are wanting one made, I do require your communication and understanding  that I am only human and cannot read minds.

If you want exact colors, give me the hex color or send me a snippet of the color. If you want a specific pose, I will try my best, I always try to do as the customer wants. Just know I'll do everything in my power to do so, but I would love a little artistic freedom in case such a pose becomes too much. I will always communicate it!


Time & Refunds.
The chance of you getting a refund when I have already started on your commission is slim to none, as I intend to finish it. However, I am a very understanding  individual and will try to give you your refund if I am taking too long due to my own health issues, emergencies (though you must communicate them to me), etc. I  MUST have a reason WHY you need your refund back or WHY you want it, and the the commission must NOT be past the coloring phase, preferably not the sketch.

PLEASE, PLEASE, do NOT get my art if you are just going to  refund it due to no longer finding my style appealing or whatnot. You will be blacklisted!

I take my time doing your commission, so please, do not freak out if it  takes a bit. The max I will take on an art piece for each individual is a  couple of months, but it shouldn't take me that long, hopefully. My mental health is not the best, but it does come first. However, I will  ENSURE you get your commission!!

Harassing me about your art will just make me speed the process up,  ending up in a sloppier product and you most likely to end up on my  blacklist OR getting a refund immediately and scrapping your piece.  Discord or a real time chat is always put up front first about  communication, and I will always send updates via a communication outlet  if you reach out or keep in touch.


Blacklist and Special Privileges.
Unfortunately,  these users on the blacklist may not commission me, buy adopts from me  or use my art in any way. I also ask they refrain from contacting me  unless they believe there is a mistake, to make amends or just generally  patch things up. I am reasonable, and I don't INTENTIONALLY want to fill this list!!

Friends, family or whomever I put on this special privilege list may get free art from me at my convenience, and I generally let use any of my premades for free, as well as bases, unless stated otherwise.

Designs, Adopts, Characters & Bases

Designs cannot be sold for more than they're worth, unless art is added to the  initial design, such as commissions. Adding premades (that cannot be transferred over to the new owner's name) or freebies does not increase the worth. YCHs, commissions and other art, including personal WILL change the value slightly. Take pride in personal work!

Designs of course can be altered in a slight way or a major way, AS long  as the original design can still be clearly shown. This means that even  if you make changes, i.e. change the colors completely or just add a  few more markings, the original design concept must be able to be recognized. I look forward to seeing your work.

As for "twin" sets, such as the same design with colored hair or just a  simple color change but same design or any slight change, it must be kept with the original design and sold as *one* character. Apologies for  any inconvenience, but it still is the same design.

Designs you do not want, I will take back. I ask design owners to let me know who now owns who and to let me know before they sell.

I ask designs not to be sold to my black-listed users.  Blacklisted users are generally cannot get ANY art related to my brand, respectfully. I may make exceptions with certain purchases but it is unlikely, as those on the list are there for a reason.

Bases, unless stated otherwise, may be used for character art and adoptables  if bought. Please, ensure the base does not say that it cannot be used  for such, otherwise, feel free to make adopts or color your character on  them.

Bases, like all other art, is prohibited to be used if you're on my black-list (see above).
 
I, unfortunately, will give no refunds on bases.

Bases can give monetary value to character, only if they were colored for the character and the colored base is included with the character in sale. Bases cannot, however, be sold uncolored or unaltered as a straight up base and not bought product with the character.

Bases are never to be re-uploaded, especially without permission and without any coloring (aka, how it was originally sold).
You may not make profit on my bases solely, nor may you edit my bases in a way where the original work is no longer recognizable due to the derivative work.

Shop items are physical items refer to the physical items I will sell in my store. Such sales, as you will read on, are FINAL sale. I do not do refunds but I will replace damaged goods.

Refund Policy + Returns on Physical Items

Any  refunds are at my own discretion. However, ALL physical sales are final  unless the package has been damaged. If your package has unfortunately  been damaged due to a shipping facility (such as USPS, FedEX, etc), I  ask you to let me know and them know what happened. I then ask you to  work with me and be patient as I try to send you a replacement.

Within maximum of 14 days after you've received your purchase, you must contact me at ruptacor@gmail.com . Explain your situation, what your product was, what is wrong with it and any information you can to help  me. The shipping address and information will help greatly to resend you a new product or the same type of product to accommodate you.

Please, do have patience with me. However, do understand I am not your mail carrier service, and I will try to get it to you in a timely  manner, but it may take longer with them.

Although all sales are final, if a wrong order was sent to you, I  request the other one back in great condition (preferable unopened,  cannot be damaged) and I'll send you the other ASAP.

Shop items that was ordered incorrectly by you may or may not be reimbursed. I do apologize for any negative impacts or inconvenience this may cause.

Refund + Returns

This ToS may be added to or shortened to how I see fit. This was updated on 5/10/22 . Any changes must be accepted by the customer before an art piece will be finished or an order will be shipped. Thank you!
